    CFA Legislative ALERT

Preserve your right to OWN your pet!

We are their protectors .... We are their owners

    Last Updated: December 13 2002

The "GUARDIAN" CAMPAIGN has come to SAN FRANCISCO! Animal rights activists want to transform the legal status of animals and extend their "rights" through the courts.

THE FIRST STEP IS LANGUAGE CHANGE.

Led by In Defense of Animals (IDA), a proposal to add the work "guardian", as interchangeable with owner, in the City and County of San Francisco Health Code, animal sections, is being considered by the SF Board of Supervisors.

The "guardian" campaign is linked to the concept of legal "personhood" which, according to Dr. Elliot Katz of IDA, will "free animals from exploitation, suffering and bondage imposed on them by their current status as property." The ultimate goal is to abolish the raising of farm animals, animals in medical research, in zoos or aquariums and to end the breeding and selling of pedigreed cats, purebred dogs and other pets.

    Don't be fooled!
Calling a pet owner a "guardian" will not help animals

Current state law says that animals are considered property. This DOES NOT MEAN that animals can be abused or treated cruelly. It DOES MEAN that owners are held responsible for acts of their animals (i.e. biting or nuisance). It also means that no one can take your pet without your permission.

    • Animals can and do benefit humans and provide mutual enrichment. Well-established property rights protect our abilities to possess, transfer, provide care and plan reproduction as long as it is humane.
    • Ownership and guardianship as legal concepts are NOT the same. Guardians accept responsibilities and duties solely to protect the ward - but the guardian has no legal rights. The guardian/ward relationship can be more easily severed than that of ownership.
    • Caring pet owners value their animals as family members. A warm sounding word does not eliminate exploitation or abuse. If a person is a bad owner he would be a bad guardian.

Tell the San Francisco Board of Supervisors to reject the addition of "guardian" to the Health Code animal sections.
Your love for your pet is being exploited for a political agenda to advance an extreme ideology.
GET THE WORD OUT! Call your friends and fellow pet lovers in San Francisco.
